Terms of Service

These Terms of Service (the “Terms”) set forth the conditions for using the application “Cheer” (the “Service”) provided by the Cheer operators (the “Operators”). By using the Service, you (the “User”) agree to be bound by these Terms.
Article 1 (Application)
- These Terms apply to all relationships between the Operators and Users regarding the use of the Service.
- Any individual notices or rules posted by the Operators within the Service form part of these Terms.
Article 2 (Definitions)

Article 3 (Account Registration)
- Use of the Service requires account registration with an email address.
- The Service is intended for persons aged 13 or older. Persons under 13 may not use the Service (except in Japan, where users under 13 may use the Service with parental or guardian consent). Minors must obtain the consent of a parent or guardian before using the Service.
- Your registered name must be 1–20 characters in Latin letters and cannot be changed after registration.
- Each person may hold only one account, which may not be transferred or lent to any third party.
- The same name may be used by multiple Users. Because cheers are addressed to a name, Users with the same name can play cheers addressed to that name even when the Cheer Request was not their own. This sharing of cheers addressed to the same name is a core feature of the Service.
- You may delete your account at any time from the settings screen in the app. Upon deletion, your registered information, sent cheers (including audio), usage history, and remaining points and chips will be deleted and cannot be restored. Your name and Cheer Request text will remain visible as part of cheers received by other users (contact us if you would like them removed).
- If registered information is found to be false, the Operators may suspend or delete the account.
Article 4 (Handling of Cheers and Cheer Requests)
- A cheer cannot be withdrawn or deleted once sent. Please check its content carefully before sending.
- Copyright in cheers and Cheer Requests belongs to the User who created them. However, the User grants the Operators a royalty-free license to use them (including storage, distribution, and reproduction) to the extent necessary to provide, operate, and improve the Service.
- Cheer Requests can be changed at any time from profile editing. These Terms (including the prohibited acts in Article 5) also apply to Cheer Requests.
- The Operators may, without prior notice, hide or delete any cheer or Cheer Request that violates these Terms or that the Operators deem inappropriate.
- If a sender deletes their account, the cheers they sent will also be removed from recipients' screens (including saved cheers). In this case, points spent by recipients on playing or saving will not be refunded.
Article 5 (Prohibited Acts)
Users must not engage in any of the following acts when using the Service:
- Acts that violate laws or public order and morals
- Sending audio containing defamation, threats, discriminatory remarks, obscene content, or anything else that makes others uncomfortable
- Infringing the copyright, portrait rights, privacy, or other rights of third parties
- Impersonating another person
- Using the Service for sales, advertising, solicitation, or other purposes not approved by the Operators
- Unauthorized access, reverse engineering, or interfering with the operation of the Service
- Fraudulently obtaining, cashing out, or trading points or chips with third parties
- Any other act the Operators deem inappropriate
Article 6 (Points and Conversion Chips)
- You earn 1 Cheer Point each time you send a cheer.
- Playing a cheer costs 1 Playback Point, and saving a cheer costs 10 Playback Points. Playing a saved cheer costs no points.
- One Conversion Chip converts 1 Cheer Point into 1 Playback Point.
- Free chips are granted at 5 per day, and you may hold up to 15 at a time.
- Paid chips can be purchased via in-app purchase and never expire.
- Free chips are consumed first; paid chips are consumed in order of acquisition, oldest first.
- Points and chips cannot be exchanged for cash or any other property of value.
Article 7 (Purchases and Payment)
- Paid chips are purchased through in-app purchase on the App Store (Apple), at the prices shown on the purchase screen in the app.
- Purchased paid chips are non-refundable except where required by law or by App Store policies.
- Disputes regarding purchase procedures or payment shall first be handled in accordance with Apple's procedures.
Article 8 (Disclosures Regarding Paid Chips)
For User protection, the following is disclosed voluntarily in line with the disclosure framework for prepaid payment instruments under the Japanese Payment Services Act.

Article 9 (Reporting, Blocking, and Restriction of Use)
- Users may report inappropriate cheers or Users to the Operators via the in-app reporting feature.
- Users may block specific Users to prevent receiving further cheers from them.
- If a User violates or is likely to violate these Terms, the Operators may, without prior notice, suspend the User's use of the Service, delete the account, or take other necessary measures.
- The Operators shall not be liable for any damage arising from the measures in the preceding paragraph, except in cases of willful misconduct or gross negligence by the Operators.
Article 10 (Changes, Suspension, and Termination of the Service)
- The Operators may change the content of the Service or suspend or terminate its provision without prior notice to Users.
- If the Service is to be terminated, the Operators will endeavor to give advance notice within a reasonable period and, after such notice, to provide Users with a reasonable opportunity to use their remaining chips.
Article 11 (Disclaimer)
- The Operators do not warrant that the Service is free from defects in fact or in law.
- The Operators shall not be liable for troubles arising from interactions between Users, except in cases of willful misconduct or gross negligence by the Operators.
- Where the Operators are liable to a User for damages, such liability shall be limited to the greater of the amount the User paid for the Service in the preceding 6 months or 10,000 yen, except in cases of willful misconduct or gross negligence by the Operators.
Article 12 (Amendment of the Terms)
The Operators may amend these Terms when they deem it necessary. In the event of an amendment, the details and effective date will be announced in advance in the app or by other appropriate means. The conditions of paid chips already purchased will not be changed to the detriment of Users. Continued use of the Service on or after the effective date constitutes acceptance of the amended Terms.
Article 13 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operators' location as the court of first instance.

Article 15 (Governing Language)
These Terms are prepared in Japanese and translated into English for convenience. In the event of any discrepancy between the two versions, the Japanese version shall prevail.
